Terms of Service

These Terms of Service ("Terms") govern your use of OwnerCars, the website and services at www.ownercars.co.uk ("the Service"), operated by OwnerCars Limited (company number 17257243), a company registered in England and Wales, whose registered office is at 128 City Road, London, EC1V 2NX ("OwnerCars", "we", "us", "our").

By creating an account, listing a vehicle, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Each time we accept your request to publish an advert, a separate agreement is formed between you and us on these Terms; placing an advert is deemed acceptance of these Terms in force at that time. You warrant that all information you provide to us is accurate and that you will keep it up to date.


1. About OwnerCars

OwnerCars is a platform that allows private individuals to advertise vehicles for sale and to communicate with potential buyers while keeping their personal contact details private. OwnerCars is an advertising platform only. We are not a party to any sale, we do not buy, sell, own, inspect, or take possession of any vehicle, and we are not an agent, broker, or dealer. Any sale is a private transaction directly between the seller and the buyer.

2. Who can use the Service

You must be at least 18 years old and legally able to enter into contracts to use OwnerCars. By using the Service you confirm that you are. The Service is intended for private sellers, not motor traders or dealers. You agree you are selling as a private individual and not in the course of a business, unless we have agreed otherwise in writing.

If you are selling in the course of a business, the law requires you to make that clear. Under the Digital Markets, Competition and Consumers Act 2024 (and related consumer protection rules), anyone advertising goods for sale in the course of business must make that fact clear to consumers. It is your responsibility to comply. We do not permit traders to advertise as, or otherwise pass themselves off as, private sellers, and we may remove adverts and suspend accounts where we reasonably believe this rule has been breached, without refund.

3. Your account

You are responsible for keeping your account details and password secure, and for all activity under your account. You agree to provide accurate information and to keep it up to date. Tell us promptly at contact@ownercars.co.uk if you believe your account has been used without your permission.

4. Listing a vehicle

When you create an advert, you agree that:

  • You are the legal owner of the vehicle, or are authorised to sell it.
  • All information in your advert is accurate, honest, and not misleading — including the vehicle's condition, history, mileage, specification, and any faults or damage.
  • You will not misrepresent the vehicle, including its write-off/insurance history or outstanding finance.
  • The photographs are genuine images of the actual vehicle.
  • Your advert and conduct comply with all applicable laws, including consumer protection and advertising rules.
  • The vehicle is in your possession and available for sale, and you have the right and ability to transfer ownership.
  • You will keep your advert accurate and will remove it promptly once the vehicle is sold or is no longer available — you must not leave a sold or unavailable vehicle listed in order to attract enquiries.

In particular, you must not:

  • advertise a vehicle that does not exist, or that has already been sold, to attract enquiries;
  • state inconsistent or incorrect mileage, including abbreviating it (for example showing "105" when the true figure is 105,000);
  • enter an artificially low price in the price field and then state a different, higher price in the description; or
  • use one advert to sell more than one vehicle.

You are solely responsible for the content of your advert. We may, but are not obliged to, review, edit, refuse, or remove any advert at our discretion — for example if it appears inaccurate, unlawful, or in breach of these Terms. No refund or credit is given for an advert removed for breaching these Terms.

5. Fees and payment

To publish an advert you pay the fee shown at the time of listing (currently a one-off launch price; standard pricing applies thereafter). Payment is taken through our payment provider, Stripe. Your advert remains live until the vehicle is sold or you remove it, subject to these Terms.

When you ask us to publish your advert, you are requesting that the Service begins immediately. Because your advert is made available as soon as it is published, you agree that fees are non-refundable once an advert has been published, and you acknowledge that by asking us to publish you lose the right to cancel that would otherwise apply to digital services supplied online. This does not affect any statutory right to a refund where we have failed to provide the Service, or any other right you have under law that cannot be excluded. No refund is due where an advert is removed because you have breached these Terms.

6. Buying a vehicle / using the Service as a buyer

OwnerCars does not verify the identity of sellers or the accuracy, condition, ownership, or legality of any vehicle advertised. Any decision to buy is yours alone. You should take normal precautions when buying a vehicle privately, including inspecting the vehicle, verifying ownership and history, confirming there is no outstanding finance, and meeting safely. We provide safety guidance, but following it is your responsibility and does not guarantee a safe or successful transaction.

While we make reasonable efforts to identify and remove suspicious or fraudulent adverts, we cannot guarantee to detect all of them, and we are not liable for content that is inaccurate, fraudulent, or otherwise objectionable. If you see an advert or message you believe is fraudulent, misleading, or suspicious, please report it to us at contact@ownercars.co.uk so we can investigate.

7. Messaging, contact details and conduct

OwnerCars lets buyers and sellers communicate through the platform without exposing personal contact details. You agree:

  • To use messaging and any contact details only for genuine enquiries relating to the purchase or sale of an advertised vehicle, and for no other purpose.
  • Not to use the Service to send spam, scams, unsolicited promotions or advertising, or abusive, harassing, or unlawful content.
  • Not to attempt to harvest or collect other users' personal data, or to circumvent the platform to mislead or defraud.
  • Not to post or share the personal data of any third party (such as another person's name, address, phone number, or email address) without a lawful basis.
  • Not to post or share unlawful, offensive, infringing, impersonating, or fraudulent content anywhere on the Service, including the Secure Vault.

We may suspend or terminate accounts that breach these rules.

8. Secure Vault and documents

The Secure Vault lets you share documents (such as service history) privately with specific users. You are responsible for the documents you upload and share, for ensuring you have the right to share them, and for redacting sensitive information you do not wish to disclose. Do not upload documents containing other people's personal data without a lawful basis.

9. Prohibited use

You must not use the Service to: advertise anything other than a genuine vehicle you are entitled to sell; list on behalf of a dealer or business while posing as a private seller; post false, misleading, or fraudulent content; infringe anyone's rights; transmit malware; scrape or copy the Service or its data; or do anything unlawful or that damages the Service or other users.

10. Intellectual property

OwnerCars, its name, branding, and the Service are owned by us and protected by law. You may not copy or reuse them without permission. You keep ownership of the content you upload (such as photos and descriptions), but you grant us a licence to host, display, and use that content as needed to operate and promote the Service.

11. Our liability

The Service is provided "as is". To the fullest extent permitted by law:

  • We are not responsible for the accuracy of adverts, the condition or legality of vehicles, or the conduct of any buyer or seller.
  • We are not a party to, and accept no liability for, any transaction, dispute, loss, or damage arising between buyers and sellers.
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that any advert will result in a sale.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including for death or personal injury caused by our negligence, or for fraud. Subject to that, our total liability to you in connection with the Service will not exceed the fees you have paid to us in the 12 months before the claim.

These Terms do not affect your statutory rights as a consumer.

12. Suspension and termination

We may suspend or close your account, or remove your adverts, if you breach these Terms, if we are required to by law, or to protect the Service or other users. You may close your account at any time. Closing your account does not entitle you to a refund of fees already paid, except as required by law.

13. Events outside our control (force majeure)

We are not liable for any delay in performing, or any failure to perform, our obligations to you if the delay or failure is due to any event outside our reasonable control — including (without limitation) acts of God, fire, flood, storm, epidemic or natural disaster, strike or industrial action, terrorist attack, infrastructure or power failure, denial-of-service attack, or failure of public or private telecommunications networks.

14. Your legal rights

Nothing in these Terms affects your legal rights as a consumer. If you would like advice about your legal rights, you can contact Citizens Advice (www.citizensadvice.org.uk) or your local Trading Standards service.

15. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. We will post the updated Terms here with a revised date. Continued use of the Service after changes means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
